Greenfield Attends Sentencing Of Shomrim Shooter David Flores To Request Maximum Penalty
UPDATE (11:23 a.m.): The sentencing of David Flores has been postponed to January 17 because the pre-sentencing report was not ready. Councilman Greenfield, via Twitter, notes that Flores pleaded guilty to an additional charge at today’s hearing, this time for scamming multiple people. The “newest guilty plea by David Flores proves, once again, that this #ShomrimShooter is a bad guy who works the justice system in his favor,” Greenfield said on Twitter.
The Daily News’ Orin Yaniv elaborates on the charges:
Original post:
Councilman David Greenfield is spending the morning in Brooklyn Supreme Court, as he attends the sentencing hearing of David Flores, the man who last month was acquitted of charges of attempting to murder Borough Park Shomrim members in 2010.
After spending more than three years behind bars awaiting trial, Flores was acquitted of attempted murder and assault charges, but found guilty of illegal possession of a firearm.
The charges stem from a 2010 incident when Flores opened fire on a group of Shomrim members he say surrounded his car and caused him to fear for his safety. The Shomrim members claimed Flores has exposed himself in front of children, and when a brawl broke out, Flores pulled a gun and opened fire, striking four Shomrim members.
Flores faces a maximum of 15 years and a minimum of five years in prison for illegal gun possession, and Greenfield sent a letter last week urging the judge to throw the book at him.
“This individual chose to carry an illegal weapon and then fire it several times on a crowded street, striking four volunteer patrol members and endangering countless other innocent bystanders. I do not agree with the jury’s decision to find him not-guilty of other charges. With that said, the jury agreed with all law-abiding New Yorkers in ruling that we cannot have criminals carrying guns around our neighborhoods. All branches of government share in the responsibility of ridding our streets of guns. That’s why I asked Judge Riviezzo to reaffirm the important message that carrying a concealed illegal weapon will lead to the maximum prison sentence when she sentences David Flores tomorrow,” said Greenfield said in a press release.
Flores has 20 prior arrestes for charges including burglary, assault, public lewdness and gun possession.
Greenfield is currently at the hearing, hoping to press the message further, according to a Tweet he sent out at 8:30 a.m.:
We’ll update this post after the sentencing concludes.
